2.2 Interpretation

  • Headings are for convenience only and do not affect interpretation.

  • Words in singular include plural and vice versa.

  • References to laws include amendments and replacements.

3. ELIGIBILITY TO USE SERVICES

3.1 Customer Eligibility

To use our services, you must:

  • Be at least 18 years of age

  • Be legally capable of entering into a binding contract under Indian law

  • Provide accurate contact and location details

3.2 Technician Eligibility

Technicians must:

  • Be legally eligible to work in India

  • Possess relevant skills and experience

  • Provide valid identification and documents when required

The Company reserves the right to approve, suspend, or terminate any technician engagement at its sole discretion.

4. SCOPE OF SERVICES

Shree Shyam Electronics provides services including but not limited to:

4.1 Residential Services

  • AC & appliance repair and servicing

  • Electrical and plumbing services

  • Handyman and home maintenance services

  • Installation and minor repair works

4.2 Commercial / Business Services

  • Office electrical and plumbing services

  • AMC and facility maintenance

  • Property and building maintenance

  • Customized business service solutions

4.3 Service Nature

  • Services are provided through independent technicians

  • The Company acts as a service facilitator and coordinator

  • Actual service execution is performed by technicians

5. BOOKINGS & SERVICE REQUESTS

5.1 Booking Process

Customers may book services through:

  • Website

  • Phone calls

  • WhatsApp

  • Any other communication channel approved by the Company

5.2 Booking Confirmation

A booking is considered confirmed when:

  • The Company acknowledges the request, and

  • A technician is assigned or scheduled

The Company reserves the right to reject or reschedule bookings due to:

  • Technician unavailability

  • Location constraints

  • Safety concerns

  • Incorrect information provided by the Customer

6. PRICING, FEES & PAYMENTS

6.1 Pricing Policy

  • Prices may be indicative or fixed depending on the service

    • Actual work required

    • Condition of equipment

    • Additional materials or labor

6.2 Payment Modes

We accept:

  • Cash payments

  • Online payments (UPI, bank transfer, or other supported modes)

6.3 Payment Responsibility

  • Customers must make full payment upon completion of service unless otherwise agreed

  • Failure to pay may result in service denial or legal action

7. CANCELLATION, RESCHEDULING & REFUND POLICY

7.1 Customer-Initiated Cancellation

Customers may cancel or reschedule a booking by contacting the Company via phone, WhatsApp, or website before the technician arrives.

The Company reserves the right to charge a cancellation or visit fee if:

  • The technician has already reached the location

  • The cancellation is made at the last moment

  • The technician is denied access at the service location

7.2 Company-Initiated Cancellation

The Company may cancel or reschedule a service due to:

  • Technician unavailability

  • Safety concerns

  • Incorrect customer details

  • Force majeure events

In such cases, no cancellation fee will be charged to the Customer.

7.3 Refund Policy

  • Refunds, if applicable, will be processed through the original payment method

  • Diagnostic or inspection charges are non-refundable

  • Refund timelines may vary depending on payment mode

8. ANNUAL MAINTENANCE CONTRACT (AMC) TERMS

8.1 AMC Scope

AMC services may include:

  • Periodic inspections

  • Preventive maintenance

  • Limited repair services as specified

The exact scope of AMC will be defined at the time of purchase.

8.2 AMC Exclusions

Unless explicitly mentioned, AMC does not cover:

  • Major part replacements

  • Damage due to misuse or negligence

  • Damage caused by external factors such as voltage fluctuations, water seepage, fire, or natural disasters

8.3 AMC Validity

  • AMC is valid only for the agreed duration

  • Unused visits do not carry forward unless stated otherwise

  • AMC is non-transferable

8.4 AMC Termination

The Company reserves the right to terminate AMC services if:

  • Customer misuses services

  • Payment obligations are not met

  • Unsafe working conditions are present

9. CUSTOMER OBLIGATIONS & RESPONSIBILITIES

Customers agree to:

  • Provide accurate address and contact details

  • Ensure safe and reasonable access to the service location

  • Disclose known issues related to appliances or installations

  • Ensure the presence of an adult during service

The Company shall not be responsible for delays or damages caused due to incorrect or incomplete information provided by the Customer.

10. TECHNICIAN / SERVICE PARTNER TERMS

10.1 Independent Contractor Status

Technicians associated with Shree Shyam Electronics are independent contractors, not employees.

The Company:

  • Does not control how services are executed

  • Is not responsible for individual work methods

  • Acts as a facilitator between Customers and Technicians

10.2 Technician Responsibilities

Technicians are expected to:

  • Perform services professionally

  • Follow safety standards

  • Respect customer property

  • Avoid misuse of customer data

10.3 Technician Misconduct

Any misconduct reported by a Customer may result in:

  • Suspension

  • Termination of association

  • Legal action if required

11. SERVICE LIMITATIONS & DISCLAIMERS

11.1 No Guarantee of Results

While the Company strives for quality, it does not guarantee:

  • Permanent resolution of issues

  • Compatibility with all appliances or systems

  • Availability of spare parts

11.2 Third-Party Components

The Company is not responsible for:

  • Manufacturer defects

  • Warranty claims

  • Performance of third-party products

12. LIMITATION OF LIABILITY

To the maximum extent permitted by Indian law:

  • The Company’s liability shall not exceed the amount paid for the specific service

These terms apply to all business, commercial, and institutional clients, including but not limited to offices, shops, factories, warehouses, housing societies, and commercial properties.

13.2 Scope of Commercial Services

Commercial services may include:

  • Electrical and plumbing installations

  • Maintenance and repair services

  • AMC and facility management services

  • Customized service solutions

The exact scope shall be defined in writing or mutually agreed communication.

13.3 Pricing & Payment for Business Clients

  • Pricing for commercial services may differ from residential services

  • Advance payments may be required

  • Delayed payments may attract penalties or service suspension

13.4 Responsibility of Business Clients

Business clients must:

  • Provide safe working conditions

  • Ensure compliance with local laws and regulations

  • Obtain necessary permissions, if applicable

The Company shall not be responsible for delays caused by non-compliance or unsafe environments.

14. DATA USAGE, COMMUNICATION & PRIVACY REFERENCE

The Company does not sell personal data to third parties.

15. INTELLECTUAL PROPERTY RIGHTS

All content on the Platform, including but not limited to:

  • Logos

  • Text

  • Graphics

  • Service descriptions

  • Software and code

are the exclusive property of Shree Shyam Electronics unless otherwise stated.

Unauthorized copying, reproduction, or misuse is strictly prohibited and may result in legal action.

16. INDEMNITY

Customers and Technicians agree to indemnify and hold harmless the Company against:

  • Claims arising from misuse of services

  • Breach of these Terms

  • Negligence or misconduct

  • Violation of applicable laws

This indemnity obligation shall survive termination of services.

17. FORCE MAJEURE

The Company shall not be liable for failure or delay in performance due to events beyond reasonable control, including but not limited to:

  • Natural disasters

  • Government actions

  • Pandemics

  • Power failures

  • Labor disputes

Services may be suspended during such events without liability.

18. SUSPENSION & TERMINATION

18.1 Termination by Company

25. TECHNICIAN CODE OF CONDUCT
25.1 Professional Behavior
All Technicians / Service Partners must:

  • Behave respectfully with Customers

  • Wear appropriate attire and maintain hygiene

  • Avoid abusive, threatening, or inappropriate language

  • Perform services with reasonable skill and care

25.2 Prohibited Actions
Technicians shall not:

  • Demand extra charges without approval

  • Misrepresent service requirements

  • Use customer premises for personal activities

  • Consume alcohol, drugs, or intoxicants during service

  • Share customer contact details for personal gain

Violation of this code may result in immediate termination of association and possible legal action.
26. SAFETY, RISK & ON-SITE CONDITIONS
26.1 Customer Safety Responsibilities
Customers must:

  • Ensure safe access to the service area

  • Inform technicians of known hazards

  • Keep pets and children away from the work area

26.2 Technician Safety Responsibilities
Technicians must:

  • Follow standard safety procedures

  • Use proper tools and equipment

  • Refuse work in unsafe conditions

The Company shall not be liable for accidents caused due to unsafe premises or customer negligence.
27. PAYMENT DISPUTES & RECOVERY
27.1 Disputed Payments
In case of payment disputes:

  • The Company may review service records and communications

  • Decisions taken by the Company shall be final unless otherwise mandated by law

27.2 Non-Payment
Failure to make payment may result in:

  • Service suspension

  • Recovery actions

  • Legal proceedings under applicable laws

All recovery costs shall be borne by the defaulting party.
28. RISK DISCLOSURE

19. DISPUTE RESOLUTION & ARBITRATION

If the dispute is not resolved amicably within a reasonable time, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996.

  • The seat and venue of arbitration shall be Narnaul, Haryana, India.

  • The arbitration proceedings shall be conducted in English.

  • The decision of the arbitrator shall be final and binding on all parties.

19.3 Costs

Each party shall bear its own costs unless otherwise decided by the arbitrator.

20. GOVERNING LAW & JURISDICTION

These Terms and any disputes arising herefrom shall be governed by and construed in accordance with the laws of India.

Subject to the arbitration clause above, the courts at Narnaul, Haryana shall have exclusive jurisdiction over all matters.

21. AMENDMENTS & MODIFICATIONS

The Company reserves the right to modify, amend, or update these Terms at any time without prior notice.

  • Updated Terms shall be effective upon publication on the Platform.

  • Continued use of services after changes constitutes acceptance of the revised Terms.

Customers and Technicians are advised to review the Terms periodically.

22. SEVERABILITY

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction:

  • Such provision shall be deemed severed

  • The remaining provisions shall continue to be valid and enforceable

23. NOTICES & COMMUNICATION

23.1 Company Notices

The Company may provide notices through:

  • Phone calls

  • WhatsApp messages

  • Email or other communication channels

23.2 User Responsibility

Customers and Technicians are responsible for ensuring their contact details are accurate and up to date.

Failure to receive communication due to incorrect details shall not be the Company’s responsibility.

24. ENTIRE AGREEMENT

These Terms, along with any referenced policies (including the Privacy Policy), constitute the entire agreement between the Company, Customers, and Technicians.

They supersede all prior agreements, communications, or understandings, whether oral or written.
